AI Governance Checklist for Enterprise Compliance Teams (2026)

Why AI Governance Can't Wait

The window for treating AI governance as a "future priority" has closed. Enterprise compliance teams are now fielding direct questions about AI governance from customers, investors, auditors, and regulators — and the answers are expected to be substantive, documented, and verifiable.

The pressure points are real and multiplying. Procurement teams at enterprise customers now include AI governance sections in vendor due diligence questionnaires. Cyber insurers are adding AI-specific risk questions to renewal applications. The EU AI Act imposes mandatory requirements for high-risk AI systems with significant enforcement penalties. And US state AI legislation — over 30 states introduced or passed AI bills in 2025 alone — is creating a patchwork of domestic obligations.

The good news: AI governance does not have to be built from scratch. A structured program covering 10 core areas puts most enterprise compliance teams in a defensible position. Here is the checklist.

The 10-Area AI Governance Checklist

1. AI Inventory

You cannot govern what you have not catalogued. An AI inventory is a complete, maintained list of every AI system in development or production — including AI embedded in third-party software, vendor-provided AI features, and tools used by employees outside of formally approved workflows. The inventory should capture the use case, the data the system processes, the stakeholders affected, and the vendor or development team responsible. Shadow AI — unsanctioned tools adopted by employees — must be actively discovered, not just assumed away. Your inventory is the foundation for every other element of this checklist.

2. AI Usage Policy

A documented AI usage policy communicates to employees what AI tools are approved, under what conditions, and what obligations they have when using AI in their work. The policy should address data handling requirements (what categories of data can and cannot be processed by AI tools), quality control expectations (what human review is required before AI output is used or communicated externally), prohibited use cases, and the process for requesting approval of new AI tools. Without a policy, every employee is making their own governance decisions — and those decisions will not always be the right ones.

3. Data Classification

Not all data carries the same risk when processed by AI systems. A data classification framework defines categories — typically along the lines of public, internal, confidential, and restricted — and establishes which AI tools are approved for processing each category. Customer personal data, regulated data (PHI, financial data, legal-privileged information), and proprietary business information all warrant heightened controls when AI is in the loop. Your AI governance program must connect your data classification framework to your AI tool approvals — ensuring that high-sensitivity data is only processed by AI systems that meet the corresponding security and contractual requirements.

4. Vendor Assessment

The AI tools your organization buys embed the governance decisions their vendors have made. Enterprise compliance teams need a structured vendor assessment process for AI tools that addresses: data retention and training practices (does the vendor train on your data?), subprocessor chains (where does data actually flow?), contractual data protections (do you have adequate DPA/BAA coverage?), security certifications (SOC 2, ISO 27001, etc.), and the vendor's own AI governance practices. The assessment should be conducted before onboarding a new AI vendor and revisited at regular intervals — vendor terms and practices change, and your agreements need to keep pace.

5. AI Training and Awareness

Governance policies only work if the people expected to follow them understand them. AI training for enterprise employees needs to cover more than a generic acceptable use policy. It should explain specifically how AI tools work at a conceptual level (why hallucinations happen, why data handling matters), what the firm's AI usage policy requires, how to identify and report potential AI-related incidents, and the specific obligations that apply to different roles. Annual compliance training is a minimum; teams that regularly use AI in high-stakes workflows (legal, finance, healthcare, customer service) should receive role-specific, more frequent training.

6. Incident Response

AI systems fail in ways that are qualitatively different from traditional software failures — hallucinations, bias amplification, data leakage through model outputs, and adversarial manipulation are among the failure modes that require specific response procedures. Your AI governance program should include an AI incident response plan that defines what constitutes an AI incident, who owns the response, what the escalation path looks like, how affected parties are notified, and how the incident is documented for regulatory and insurance purposes. This plan should be tested — tabletop exercises for AI-specific scenarios are increasingly expected by enterprise customers and insurers.

7. Audit Trail

Regulators, customers, and plaintiff's attorneys will ask for documentation. Your AI governance program needs to produce and maintain a defensible audit trail covering: when AI systems were deployed and who approved them, what risk assessments were conducted and what findings they produced, what controls were implemented and when, what incidents occurred and how they were resolved, and how employee training obligations were fulfilled. The audit trail is not just a retrospective record — it is the evidence that your governance program is real, operational, and consistently applied. Without it, your policy documents are just paper.

8. Framework Alignment

Enterprise compliance teams increasingly need to demonstrate alignment with recognized AI governance frameworks — both because regulators reference them and because customers ask about them. The two most relevant frameworks in 2026 are the NIST AI Risk Management Framework (voluntary, US-focused, principles-based) and the EU AI Act (mandatory for organizations with EU market exposure, risk-tiered, rules-based). Your governance program should be explicitly mapped to the applicable framework(s) — not just generally consistent with them, but documented against specific requirements. This mapping is what allows you to answer customer due diligence questions with specificity rather than generality.

9. Executive Reporting

AI governance is not a purely operational function — it requires executive visibility and board-level awareness. Your governance program should include a regular reporting cadence to leadership covering: the current AI inventory and any significant changes, the organization's AI risk posture and any material findings, the status of remediation activities, and any incidents or near-misses. This reporting serves two purposes: it keeps leadership informed so they can make appropriate decisions, and it creates a documented record of leadership engagement with AI risk — which regulators and auditors will increasingly expect to see.

10. Ongoing Monitoring

AI governance is not a one-time project. The AI landscape changes rapidly — new tools emerge, existing tools change their practices, regulations evolve, and the organization's AI use cases expand. A mature governance program includes ongoing monitoring: periodic re-assessment of the AI inventory to capture new tools and changes to existing ones, regular review of vendor terms and practices, monitoring of regulatory developments in relevant jurisdictions, and periodic testing of AI systems for performance degradation, bias drift, and security vulnerabilities. The cadence should match the pace of change in your AI environment — for most enterprises, a quarterly governance review is a reasonable minimum, with more frequent monitoring for high-risk systems.
