If your organization develops, deploys, or relies on AI systems, two frameworks now shape your compliance landscape more than any others: the NIST AI Risk Management Framework (AI RMF) and the EU AI Act. Understanding how they differ — and where they overlap — is essential for any compliance or legal team building an AI governance program in 2026.
The challenge is that these frameworks were built from different starting points, address different audiences, and impose different obligations. Organizations that try to comply with one without understanding the other will end up with gaps. Organizations that understand both can build a single, rationalized program that satisfies both sets of requirements with less duplication of effort.
The National Institute of Standards and Technology released the AI Risk Management Framework in January 2023. It is the product of extensive industry consultation and is designed to help organizations manage the risks that AI systems pose to individuals, organizations, and society.

The AI RMF is a voluntary framework. NIST does not have enforcement authority, and there is no penalty for non-compliance. However, "voluntary" does not mean "inconsequential." Federal agencies have begun referencing the AI RMF in procurement requirements, and enterprise customers increasingly use it as a baseline when evaluating AI vendors. The Act categorizes AI systems into four risk tiers:
High-risk AI systems face the most significant requirements: mandatory risk assessments, technical documentation, human oversight mechanisms, data governance requirements, logging and audit trails, and registration in an EU-maintained database. General-purpose AI models — including large language models — face additional transparency and compliance obligations.
Enforcement is handled by national competent authorities within each EU member state, with significant fines for violations: up to €35 million or 7% of global annual turnover for prohibited AI systems, and up to €15 million or 3% for other violations.
The most fundamental difference is legal force. The AI RMF is voluntary guidance; the EU AI Act is law. This shapes how each should be prioritized in your compliance program.
Geographic scope is equally important. The EU AI Act has extraterritorial reach — similar to GDPR, it applies to any organization that places AI systems on the EU market or whose AI outputs affect people in the EU. A US-based SaaS company with European customers may be directly subject to the Act even if it has no EU offices.
The AI RMF's scope is the reverse: it is primarily relevant for US operations and US-market stakeholders, including federal procurement and US-regulated industries. It does not have extraterritorial reach, but it is increasingly referenced by US state AI legislation, which is proliferating rapidly.
The frameworks also differ in their approach to risk. The AI RMF asks organizations to assess risk in context and apply proportionate controls — it is principles-based and flexible. The EU AI Act prescribes specific requirements for specific risk categories — it is rules-based and prescriptive. Compliance with the EU AI Act for a high-risk system requires demonstrating specific technical and procedural controls; alignment with the AI RMF requires demonstrating a mature risk management culture and process.
The answer is often "both," but the specifics depend on your business model and markets.
Your organization should treat EU AI Act compliance as legally mandatory if you: develop or deploy AI systems used by EU-based customers or employees; process personal data of EU individuals using AI; or provide AI-powered services to organizations that do any of the above. The "placing on the market" standard is broad — if EU users can access your product, you are likely within scope.
Your organization should treat NIST AI RMF alignment as a commercial priority if you: sell to US federal agencies or their contractors; operate in a US-regulated industry (finance, healthcare, legal) where AI governance is increasingly expected; or have enterprise customers that include AI governance questionnaires in vendor due diligence.
For most mid-market and enterprise organizations with any US or EU commercial activity, both frameworks are relevant — and the good news is that they are more complementary than contradictory.
Despite their differences, the NIST AI RMF and EU AI Act share substantial common ground. Both require organizations to maintain an AI inventory, conduct risk assessments, implement human oversight, document technical characteristics of AI systems, and establish incident response processes. The conceptual vocabulary differs, but the underlying requirements point in the same direction.
A rationalized compliance program starts with the EU AI Act's risk categorization — because it is legally mandatory, it sets the floor. For any AI system that falls into high-risk categories, the EU Act's technical requirements (risk management system, data governance, transparency, human oversight, accuracy and robustness, logging) establish the minimum controls.
The NIST AI RMF then provides the governance architecture — the "how" of organizing, staffing, and operating an AI risk management function. The AI RMF's GOVERN function maps directly to what the EU Act requires in terms of organizational accountability; the MAP and MEASURE functions provide the analytical tools for conducting the risk assessments the Act requires; and the MANAGE function covers the ongoing monitoring and incident response obligations.
Organizations that implement the AI RMF's four functions thoroughly will find that most of the EU AI Act's procedural requirements are already satisfied. The remaining gap is typically the EU Act's specific technical documentation and registration requirements for high-risk systems — which can be addressed with targeted additions to an AI RMF-based program.
